These terms apply to purchases from The ELA Innovator, operated by Danielle Staley, a sole proprietor, at 220 Sunrise Ct., Cannon Falls, MN. By purchasing or using a product, you agree to these terms.
1. Digital products and memberships
Products are digital teaching resources; no physical item is shipped. Individual listings describe what is included. Secure download options appear after checkout, and a backup delivery link is emailed to the checkout address.
The membership costs $15 per month or $149 per year unless a promotional price is shown at checkout. It provides the Starter Pack and curated releases during active paid membership. It does not unlock the entire historical library.
2. Single-teacher license
Each purchase provides one non-transferable license for one teacher. You may adapt the materials for your own classes and share the resulting classroom materials with your own students and their families.
You may not share the original product files with another teacher, place them in a staff-accessible drive or shared resource library, resell or redistribute them, include them in another product, or use them to train a public AI model. Contact blumedora@gmail.com for team or school licensing.
3. Membership billing and access
Membership renews automatically until canceled. Each paid period earns the releases provided for that period. Cancellation stops future billing and normally leaves access active through the paid term. Files properly obtained before cancellation remain licensed to you, unless the related payment is refunded.
Refunds and accidental renewals are governed by the Refund Policy.
4. Professional review and student privacy
These resources assist educators in creating drafts. AI-assisted output can be inaccurate, biased, incomplete, or inappropriate for a particular class. You remain responsible for reviewing, verifying, and adapting everything before it reaches students, families, administrators, or a grade book.
Do not place identifiable student data into our website, support channels, or an AI service. Follow your school or district rules for curriculum, technology, artificial intelligence, accessibility, and student data. District policy takes priority over suggestions in our materials.
5. Payments, taxes, and delivery
Stripe processes payments in U.S. dollars. Applicable taxes may be added where required. Price changes apply only to future purchases or renewals and will be disclosed before the affected charge. Contact us promptly if a delivery email does not arrive.
6. Intellectual property
Except for third-party material identified within a product, The ELA Innovator retains its rights in the original resources. Your purchase grants the license described above rather than ownership of the source materials. Original lesson plans and classroom materials you create remain yours, subject to any rights in included source content.
7. Disclaimers and limitation of liability
To the extent permitted by law, products are provided “as is” and “as available” without a promise that they will meet every curriculum, technical, administrative, or legal requirement. Nothing here excludes a warranty or consumer right that cannot legally be excluded.
To the extent permitted by law, our total liability for a claim related to a product or these terms will not exceed the amount you paid The ELA Innovator during the 12 months before the claim. We are not responsible for indirect or consequential losses resulting from use of the resources where such a limitation is legally permitted.
8. Suspension and termination
We may suspend access for nonpayment, fraud, chargeback investigation, redistribution, or another material violation. When practical, we will contact you first. Terms concerning licensing, intellectual property, professional responsibility, and liability continue after access ends.
9. Governing law
These terms are governed by Minnesota law, without regard to conflict-of-law rules. Subject to any consumer rights that require another forum, disputes may be brought in the state or federal courts serving Goodhue County, Minnesota.
